These Terms of Service ("Terms") constitute a legally binding agreement between you and Malta Digital (CNPJ 51.110.175/0001-92), operating as Gaffer FC ("we", "us", "our"), governing your access to and use of gafferfoot.com and all associated content, features, and services (collectively, "the Service"). By accessing or purchasing the Service, you agree to these Terms in full.

1. Eligibility

You must be at least 16 years old to use the Service. By accepting these Terms, you represent that you meet this requirement. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

You must create an account to access paid features. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at brndorust@gmail.com if you suspect unauthorised access. We reserve the right to suspend accounts that violate these Terms.

3. Purchases & Payment

The Service is offered on a one-time purchase, lifetime access basis. Prices are displayed in USD and are inclusive of applicable taxes where required by law. Payment is processed securely by Stripe, Inc. By completing a purchase, you agree to Stripe's end-user terms. We reserve the right to change pricing at any time; changes do not affect existing lifetime purchases.

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own private, non-commercial purposes.

All content on the Service — including text, graphics, diagrams, interactive features, software, and trademarks — is owned by or licensed to Malta Digital and is protected by applicable intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.

The Service does not currently support user-generated content. If this changes, we will update these Terms accordingly.

8. Service Availability

We aim to maintain continuous availability but do not guarantee uninterrupted access. We may suspend or modify the Service for maintenance, security, or legal reasons without prior notice, though we will endeavour to notify you in advance of planned downtime.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. We do not warrant that the Service will be error-free or that defects will be corrected.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Malta Digital's total liability for any claim arising out of or related to the Service is limited to the amount you paid us in the 12 months preceding the claim. In no event are we liable for indirect, incidental, special, consequential, or punitive damages.

Nothing in these Terms limits liability for death, personal injury, fraud, or any liability that cannot be excluded under Brazilian consumer law (CDC – Law 8.078/1990).

11. Indemnification

You agree to indemnify and hold Malta Digital and its officers, directors, and employees harmless from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Service.

12. Termination

We may suspend or terminate your account at any time for violation of these Terms, with written notice where practicable. Upon termination for breach, no refund is owed. You may close your account at any time by contacting us — termination by you does not automatically entitle you to a refund outside the 7-day guarantee window.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of Brazil. Any dispute arising from these Terms shall be submitted to the courts of the comarca of the user's domicile or, at the user's option, the courts of São Paulo, SP, Brazil, as provided by the Brazilian Consumer Defense Code (CDC Art. 101, I).

14. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated via email or site notice at least 15 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
